This Privacy Policy governs how we, Quantum CorpHealth Private Limited, a company duly incorporated under the provisions of the Companies Act, 2013, having its registered office at 301, Gundecha Solitaire, Floor 3, CTS No. 168/1 Borivali East, Mumbai 400066, India (collectively, “Quantum CorpHealth” or “Company” or “we” or “us” or “our”) collect, use, share, store and process the information supplied by every person (“User” or “you” or “your”) accessing and using any version of the Company’s proprietary mobile application i.e. doctor911 (the “App”) or our website, https://quantumcorphealth.in/  (the “Website”) using a compatible device. Information, including any personal data, may be supplied by the User (“User Information”) in the course of availing or proposing to avail or accessing or facilitating provision of certain services that are made available on our App and Website (“Services”). Collection, use, sharing, storing and processing of your information, will also be subject to and be guided by such Service Terms and accordingly, you are requested to carefully read the Service Terms before accessing and using our Website and/or App and availing or accessing of any Services.


Quantum CorpHealth, owner of the App, respects your privacy, and seeks to comply with applicable legal requirements, including the Information Technology Act, 2000, Digital Personal Data Protection Act, 2023 and all applicable rules, regulations and guidelines in respect of data collection, processing, storage and transfer, as amended, replaced and/or supplemented from time to time (“Applicable Law”).

 

By downloading the App and/or accessing the Website, the User who so downloads the App and/or uses the Website, agrees and consents to this Privacy Policy. The Company reserves the right to make changes to this Privacy Policy by posting the new/updated version and the User’s continued use and/or accessing the Website and/or App, shall indicate the User’s agreement to such changes. If the Company makes any changes to this Privacy Policy, the Company will notify the Users, which may including a pop-up notification or placing a prominent notice on the Website and App. The change will become effective as of the date of posting.

 

The Company urges and encourages the Users and/or the visitors of the Website to read this Privacy Policy so as to better understand their rights and obligations under this Privacy Policy. By accessing or using this App and/or the Website, you agree to be bound by the terms described herein and all the terms incorporated by reference. Such personal data may include any financial information such as bank account, credit card, debit card or other payment instrument details, medical or health records, qualification or certification information, biometric information, etc. that may identify you. However, personal data does not include data that has been irreversibly anonymized or aggregated so that we cannot identify you through it, even in conjunction with other information available to us.

 

By signing up on the App or proceeding to the Website and / or accessing our Services you represent that you voluntarily provide us with your Personal Data and consent to its collection, use, storage, processing and disclosure in accordance with this Privacy Policy and the Service Terms. You also represent that you are duly authorized by any third party (including your family member or employee) whose information you share with us and that we shall be entitled to act as per your representation of such authority. 3.       WHAT TYPES OF DATA DO WE COLLECT


When you sign up or register on the App or Website to access or use our Services, and during the course of actual usage of or access to our Services, the types of Personal Information that will be collected by us include the following:

 

(a)    Contact information: Name, Address, Contact details, Email ID, Phone Number;

(b)    Demographic information: Gender, Date of Birth, Nationality;

(c)    Data regarding your usage of or access to the Services such as search history and history of the appointments made by or with you through the use of Services;

(d)    Financial information such as bank account or other payment instrument details and billing information other than credit card or debit card or payment account number, subject to applicable laws;

(e)    Your browsing history including the Uniform Resource Locator (“URL”) of the site that you visited prior to visiting the Website as well as the Internet Protocol (“IP”) address of your computer (or the proxy server you used to access the World Wide Web), your computer operating system and type of web browser you are using, the name of your Internet Service Provider (“ISP”);

(f)     Any additional information that you provide to us during the use of the Services, through any mode of communication or during any interaction and correspondence with employees, doctors, technicians, consultants, etc., of Quantum CorpHealth or any of its affiliates or partners/ vendors, including while accessing its Services;

(g)    Data regarding your medical qualifications, registrations, and certifications;

(h)    Health information such as your medical records and history which you voluntarily provide or is generated on the access to any of the Services;

(i)     Information regarding your insurance coverage (such as your insurance carrier and insurance plan) which you voluntarily provide or is generated on availing or accessing of any of the Services;

(j)     Information regarding your physical, physiological, and mental health condition which you voluntarily provide or is generated on the usage or access of the Services including information such as (i) inpatient and emergency department data; (ii) outpatient registration, scheduling, and encounter data; (iii) laboratory data; (iv) radiology data; (v) pharmacy orders data; (f) e-prescribing data; (vi) pharmacy dispensing data; (vii) medical administration data; (viii) administrative and operational data; (ix) transaction data; and

(k)    Any other detail relating to the above as voluntarily provided to us by you, for providing value- added service.

 

The Company will be required to collect information that is required to enable you to login to the App and/or Website and for the Company to verify your identity and provide Services.

 

4.       WHERE DO WE COLLECT YOUR DATA FROM


(a)    End users/ customer data:

·         Any information that you voluntarily choose to provide to us through the App, Website, email, or during interaction with us on call or chat, and other modes of communication;

·         Information that we collect from healthcare service providers (“HSPs”) such as doctors, hospitals, diagnostic centres, chemists, etc. in the Quantum CorpHealth group, to whom you have permitted the sharing of your Personal Information;

·         Data you have provided to any group company of the Company, affiliates or associates, to whom you have given consent for sharing of such information.

 

(b)   For doctors/vendors of the Company:

·         Before onboarding you, we may request information regarding your qualifications, experience, public profile, and representations made by you to us;

·         During your usage of the App /Website, we may collect information based on your access/use/facilitation of the Services;

·         We may collect other information that you voluntarily choose to provide to us through the App, Website, email, during interaction with us on call or chat, and other modes of communication;

·         Data you have provided to any group company of the Company, affiliates or associates, to whom you have given consent for sharing of such information.

In order to enhance the Company’s ability to provide valuable services and experiences to the Users, the Company may automatically or with you granting an access, receive, collect and analyse the User’s location information which may be accessed through a variety of methods including, GPS, IP address, cell tower location, device information (including storage, model, installed apps, WiFi, mobile network), communication information including the User’s contacts.

 

In addition, by use/ access by you of the Website or App, the Company may also automatically receive and collect certain anonymous information in standard usage logs through the web server, including “cookies”, network information, standard web log information and any other available information. The Website/App, like many other websites and online applications, uses “Cookies”. Cookies are small data files that are stored on your web browser. These are used for the purpose of storing your preferences, previous activities browsing activities, profiling, and tracking behavior. By visiting the App or Website, you acknowledge, accept and expressly authorize the placement of cookies. We recommend that you clear the cookies stored from time to time. User may encounter “Cookies” or other similar functions on the App that are placed by third parties. The Company does not control the use of Cookies by third parties. The User has the ability to accept or decline Cookies.

 

5.       HOW DO WE USE YOUR DATA

 

Generally, we will use, process, share and store any User information, including personal information only to provide Services, facilitate or enhance the operation of the Website or App, improve the Company’s marketing and promotional efforts and/or to provide the Users a better experience. Without prejudice to the foregoing, we use your Personal Information for purposes that include the following:

(a)    General (end users/customers and doctors and vendors):

 

·         Your registration for the purpose of accessing our Services, identification, communication, notification, and for the fulfilment of the Service Terms.

·         Offering personalized Services and targeted advertisements of various healthcare and wellness plans and offering you customized health insights;

·         Addressing your requests, queries, and complaints, if any, pertaining to our Services; taking feedback, assisting you with the completion of transactions or other issues relating to the use of Services and other customer care-related activities;

·         Leveraging services from Quantum CorpHealth group companies and customizing suggestions for appropriate medical products and services;

·         Creating insights for corporate/business strategy and marketing operations of Quantum CorpHealth group companies;

·         Developing machine learning algorithms and tools to improve targeting of services, diagnostics and treatment protocols, and other products and services;

·         Contacting you to provide information on new services, features, products, special promotions or offers, both for the Quantum CorpHealth group entities and affiliates as well as third-party offers or products with whom we have a tie-up and which are relevant to the use of the Services;

·         Technical administration and customization of Website or the App, and other general administrative and business purposes;

·         Research (internal or otherwise), fraud, security, risk management, and analysis for the development and improvement of products and services including the provision of tokenization services offered by payment aggregators/ card networks, etc. as per card networks rules;

·         Disclosure as required to government authorities in compliance with applicable law;

·         Carrying out our obligations in relation to any agreement with affiliate companies, Quantum CorpHealth group companies, our business partners, or contractors including, but not limited to, the provision of tokenization services to payment aggregators / card networks / card issuers, on a global basis as necessary to provide the tokenization services, or for compliance of applicable laws, regulatory requirements or investigations;

·         Investigating, enforcing, and resolving any disputes or grievances; and

·         We may use the information that we collect to prevent illegal activities, to enforce the Privacy Policy, and to otherwise protect our rights and the rights of our Users.

·         In addition to the uses identified above, we may use the Personal Information that we collect for any other purposes disclosed to you at the time we collect your information.

 

(b)   Legal Requests and/or Compliance with Applicable Laws

 

We cooperate with law enforcement and regulatory inquiries, as well as other third parties to enforce laws, such as intellectual property rights, fraud and other rights, to help protect you and the community. Therefore, in response to a verified request by any statutory authority including but not limited to law enforcement agency or other government officials relating to a criminal investigation or alleged illegal activity, we may (and you authorize us to) disclose, as per the applicable laws, some of your personal information as is reasonably necessary to respond /comply with the statutory mandate including but not limited to court orders, or other legal process. We may access, use, transfer or disclose your Personal Information to third parties such as government or law enforcement authorities or private parties, if it is legally and statutorily required to do so under any of the following conditions:

·         To satisfy any applicable law, rule, regulation, governmental requests or legal process.

·         To protect and/or defend and/or enforce our Privacy Policy for online services or other policies applicable to any online services in case of potential violations.

·         To secure our systems.

·         To respond to any third party claims.

·         To protect the rights, property or personal safety of the Users and the public in general for any reason.

·         To detect, prevent or otherwise address fraud, security breach or technical issues.

·         To prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity.

·         In case of any illegal, unethical or legally actionable activity, we may use IP address or other device identifiers, to identify Users, and may do so in cooperation with third parties such as internet service providers, wireless service providers and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion. Such disclosures may be carried out without notice to you. However, we shall not sell, share or rent the Users Personal Information to any third party or use any User’s e-mail id for sending any unsolicited e-mails, without such User’ consent.

 

 

(c)    For end users only:

·         We may use your information (i) to create and maintain health records in electronic form in our Personal Health Record (PHR) database for use by us and our group companies, affiliates, etc., to provide relevant services to Users and create unified profile with analytics and insights generated through processing your Personal Information; (ii) for sharing your information with your chosen HSP like doctors, hospitals, diagnostic centers, and chemists who may provide you services under the App or Website; and (iii) for processing any orders/requests you may place using our Services.

 

(d)   For doctors only:

·         We may use your information: (i) for verifying your professional credentials and any representations you have made to us; (ii) for processing any payments made to you; (iii) for providing recommendations to end users based on your expertise and specializations; or for providing any other service.

 

We share much of our data, including information about You, with our affiliates, that are committed to serving your online requests and related services. As we continue to develop our business, we might sell or buy stores, subsidiaries or business units. In such transactions, Users’ Information generally is one of the transferred business assets but shall remain subject to the terms and conditions contained in this Privacy Policy. The Personal Information may also be shared with third party products/service providers who shall also be subject to the privacy principles contained in this Privacy Policy.

 

6.       HOW LONG WILL WE RETAIN YOUR DATA

 

We store your personal information in accordance with Applicable Laws, which means we keep your data for as long as necessary to provide the Services or as may be required under any law. We shall store your Personal Information for lawful purposes only. We keep de-identified data for research and statistical purposes for a longer period.

If you close your account, we have no obligation to retain your data, and we may delete any or all of your data without liability. However, we may retain data related to you if we believe it may be necessary to prevent fraud or future abuse, if required by law, or for other legitimate purposes. We may continue to store your data in anonymized or de-identified form for analytical, research, or other purposes for which your information is collected as previously indicated.

 

7.       DISCLOSURE AND TRANSFER OF YOUR DATA

 

We may share, disclose and in some cases transfer or disclose your Personal Information to such entities or persons as required to provide Services, improve our Services, and provide value- added services or other third-party products and services, to the extent permitted by Applicable Law. These entities or persons may be located outside India, which you hereby consent to. We require such entities to protect your information through equivalent security measures as we would adopt. An indicative list of entities we may disclose or transfer information is provided below:

(a)      Service Providers:

·         We share Personal Information with companies that provide Services on our behalf, such as website hosting, data storage, software services, email services, marketing, fulfilling customer orders, providing payment-related services including payment aggregation, data analytics, data mining, providing customer services, and conducting surveys, as permitted by applicable law. These companies may be located within or outside India, but in any case, are obligated to protect your Personal Data.

·         We may also share information with employees, data processors, consultants, business partners, and technology partners on a need-to-know basis. Such entities would be contractually obligated to maintain confidentiality in relation to your Personal Data.

·         If you are an end user, your Personal Information will also be shared with your chosen HSPs.

 

(b)     Business Affiliates:

·         We may disclose or transfer some of your Personal Information to entities in the Quantum CorpHealth group companies, affiliates (including foreign entities), and in particular group companies and affiliates who are involved in the provision of products and services, to the extent permitted by Applicable Law.

·         In the event of a merger, reorganization, acquisition, joint venture, assignment, spin-off, transfer, asset sale, or sale or disposition of all or any portion of our business, including in connection with any bankruptcy or similar proceedings, we may transfer any and all Personal Information to the relevant third party with the same rights of access and use.

 

(c)      Law Enforcement Agencies:

·         We may share information with law enforcement agencies pursuant to lawful requests for information, and otherwise as required under any law applicable at the given time, both in India and outside India.

 

(d)     Other Third Parties:

·         We may also disclose Personal Information if we determine in good faith that disclosure is reasonably necessary to protect our rights and pursue available remedies, enforce our terms and conditions, investigate fraud, or protect our operations or Users;

·         We may disclose Personal Information to any third party if necessary to provide or improve our Services, fulfil any lawful contractual obligation we are bound by, and any other activity related to the purposes identified in this Privacy Policy and the terms and conditions you agree to when you use or access our Services; and

·         Anonymised, aggregated data not involving any Personal Information, may be shared with advertisers, research firms, and other partners.

8.       CROSS-BORDER INFORMATION

The internet is spread worldwide and if the User is downloading, accessing, browsing and using our App or Website from outside India, the User’s visit will necessarily result in the transfer of information across international borders. By visiting this App and/or Website, accessing the Services and communicating electronically with us, you will be deemed to have consented to these transfers and be subject to the terms of this Privacy Policy. 

9.       CHILDRENS’ INFORMATION

·         We do not knowingly solicit or collect Personal Information from children under the age of 18 and use of our App and Website is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If any Services are proposed to be availed in respect of children or persons with disabilities who may not be competent to avail the Services directly, our App and/or Website should be accessed only by the parents or lawful guardian of such person.

·         Any information in respect of children /persons with disability should be provided to us, only through the parents or lawful guardian of such persons. Any use of such information by us would continue to be subject to the terms of this Privacy Policy and Applicable Laws.

 

10.   HOW DO WE PROTECT YOUR DATA 

·         We are committed to maintaining the privacy of the Personal Information uploaded by you on the Website and App and complying with the industry-standard security safeguards for the purpose of securing the App and the Website and the Personal Information provided/uploaded by you.

·         We use reasonable technical, administrative, and physical security measures for the purpose of safeguarding all Personal Data you share with us such as: (i) only sharing and providing access to the Users’ Personal Information to the minimum extent necessary, subject to confidentiality restrictions where appropriate, and on an anonymized basis wherever possible; (ii) using secure servers to store the Users’ information; (iii) verifying the identity of any individual who requests access to information prior to granting them access to Personal Information; and (iv) using Secure Sockets Layer (SSL) software or other similar encryption technologies to encrypt any payment transactions the User makes on or via the App or Website.

·         We also have internal policies in place to prevent unauthorized access to your Personal Data and require that the third parties we share data with, also adopt reasonable levels of security practices and procedures, to ensure the privacy and security of your Personal Information.

·         The security of the Users’ Personal Information is very important to us, but please remember that no method of transmission over the internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable and legally mandated means to protect the Users’ Personal Information, we cannot guarantee its absolute security.

·         It is also possible for any Personal Information to be obtained illegally by others, such as “hackers,” and used in an inappropriate manner and you agree that we are not responsible to provide any damages to you in relation to the same.

·         As a consideration for accessing or interacting with our Website/App in any manner and/or accessing our Services, you agree to and waive all claims of any nature against us, concerning the loss, alteration, or misuse of your Personal Information. We are not and will not be responsible for any loss, unauthorized access, safety issue, or any harm caused to you by any misuse of your Personal Information, unless it is a direct and foreseeable consequence of gross negligence and non-compliance on our part only. Further, you are liable to indemnify the Company as per the Terms of Use/ Service Terms.

Our Website and App may contain links to third-party services and website, and give you the ability to access such third-party websites, products, and services. These sites are governed by their own privacy policies, and we are not responsible for the content or information practices of such third parties. Please note that you may proceed to the use of such third-party websites or services at your own risk and the Company will not be held liable for any outcome or harm arising as a result of your use of such third-party websites or services. 12.   YOUR RIGHTS AND OPT-OUT


We take reasonable steps to ensure that your Personal Information is accurate, complete, and up to date, to the extent furnished to us. However, you have the sole responsibility of ensuring that you review the accuracy of the information provided by you and contact us in case of discrepancies or changes to the information provided by you to us, or in case you wish to discontinue the use of or access to our Services. You have the following rights with regard to your Personal Information: 

·         You have the right to access and review your Personal Information shared with us and request updation, correction and/or deletion. If your Personal Information changes, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through info@doctor911.life. We will make good faith efforts to make the requested changes in our active databases as soon as reasonably practicable. If you provide any information that is untrue, inaccurate, out of date, or incomplete (or subsequently becomes untrue, inaccurate, out of date or incomplete), or we have reasonable grounds to suspect or if we become aware that the information provided by you is untrue, inaccurate, out of date or incomplete, we may, at our sole discretion, discontinue your access to our App and Website and/or the provision of the Services to you (wholly or in part). Since our Services may be largely dependent on relevant, accurate and complete information being provided to us, it is imperative that you update and maintain accurate and complete information with us.

·         There may be circumstances where we will not be able to correct, delete or update your Personal Information, including (a) where the Personal Information is opinion data that is kept solely for evaluative purposes; (b) the Personal Information is in documents related to a prosecution if all proceedings relating to the prosecution have not been completed; and (c) where your Personal Information has already been processed in de-identified form.

·         You are free not to share any medical or other Personal Information that you consider confidential and do not wish to disclose. You may also withdraw consent for us to use any Personal Data that you have already provided. In the event that you refuse to share any information or withdraw consent to process Personal Information that you have previously given to us, we reserve the right to restrict or deny your access to our App and Website and/or the provision of our Services (wholly or in part), for which we consider such information to be necessary.

·         Please note that any withdrawal of consent as set out above, will not affect the lawfulness of our use and processing of your information on the basis of your consent previously provided in terms of this Privacy Policy, where such consent was required, and the right to have the Personal Information transferred to a third party in terms of this Privacy Policy, before your consent is withdrawn.

Any changes to our Privacy Policy will be posted on the Website/ App and will become effective as of the date of posting. If you do not agree with any such revised terms, please refrain from using our Services and accessing the App and Website. In such case, kindly contact our grievance redressal and nodal officer, set out below to close any account you may have created.
